Legal Question in Bankruptcy in California

What if my bankruptcy is not discharged?

If I stop paying on the things that I am really struggling to pay(car payments, credit cards, etc.) right now, am I risking the chance that my bankruptcy may not be discharged?

Re: What if my bankruptcy is not discharged?

Thank you for your inquiry. Stopping payment on debts you cannot afford will not create a discharge problem... in fact it is recommended. The only way your discharge may be denied or impeded is if you commit fraud, abuse the bankruptcy system, or have enough money left over to repay your debts in a Chapter 13 bankruptcy.

I hope this helps, but if you need other questions answered, please feel free to email me at [email protected].

That depends on what the history of usage and payments is on each debt and what chapter you file under. If you would like a consultation to evaluate and assess your circumstances, please visit my webpage at http://www.bklaw.com/consult.html and contact me to schedule a time.
