Legal Question in Bankruptcy in California
Bankruptcy & Divorce
Unsigned judgment says I'm divorced. Rental property sold following month. Ex filed bankruptcy 3 months later. Bankruptcy courts say we're still married and want my half of $ from property & I haven't filed for bankruptcy. Is the $ a separate asset?

Re: Bankruptcy & Divorce
I'm not sure I understand your question. When you are married, any property that you earn or purchase during marriage is community property. Any property that you brought into the marriage is separate property, unless the other spouse contributed to any increase in value in the property. This is a very tricky area of law, so you really need to be more specific with your facts and questions in order for me to give you a more adequate answer.
