I am a private note holder in California. The borrowers on the note are in default due to non-payment. The wife filed bankruptcy as an individual but the husband did not. they are on title together, can I proceed with foreclosure against the husband?

You might want to consult with a bankruptcy attorney on this. It might be more efficient to seek relief from stay from the bankruptcy court, so that you can proceed with a nonjudicial foreclosure.
