Legal Question in Bankruptcy in California

I have a past creditor that wants payment, I was considering bankruptcy to just be done with it, my only problem is that I was recently married. Can I file a bankruptcy on MY credit only?, and will it effect my husbands credit at all?

Yes you can file without your husband in your name only, but his credit will be effected once you are married assuming you are California residents.

To avoid this problem, the better option is to let me negotiate the debt, assuming you only have one creditor

Yes you can file by yourself. The bankruptcy will not affect your husband's credit. However any debts that were incurred after you got married he will still be responsible for.

I agree with Mr. Markus. You can put a statement on your petition that you were just married and all debts listed are your pre-marriage debts. Please let me know if you need assistance.
