If you are the plaintiff in a lawsuit in California and are now having to claim bankruptcy because you have exhausted your assets. Would your creditors put a lean on possible future settlement monies? The bankruptcy would take place before any settlement is reached.

It depends on the nature of your claim. If for personal injury, you could exempt a portion of the recovery. You have to list the lawsuit. The BK trustee will want to hire an attorney to either prosecute or compromise the claim fir the creditors' benefit. So let your attorney know about it before you file the BK.
