Legal Question in Bankruptcy in California
Bankruptcy Repo
I received a discharged from chapter 7 BK in the February 07. My boat was included but it has been over a year now and I still have never heard from the lender to repo or reaffirm the boat. My old attorney told me to use the boat while I can, which I have and even re-registered the boat. My question isIs there any statute of limitations on the lender to repo the boat in which I can get the pink slip or can they take the vehicle whenever they want?? I have sent them multiple letters but have not pushed the issue since I am using the boat.

Re: Bankruptcy Repo
Yes, the statute of limitations is 5 years. After 5 years, you may file an action in Superior Court to declare that the boat is yours.
