Re: Can bankruptcy stop a lien?

Bankruptcy can stop, temporarily the enforcement of a lien. Some liens can be avoided (removed) and some cannot. Generally, liens that can be avoided include: wage garnishments, bank account levies and judgment liens recorded against your home unless the judgment is for child support, debt owing to the gov't or for student loans and sometimes fraud. Liens that cannot be avoided include: tax liens, child support liens, mortgages against your home, purchase money liens (secured collateral), and judgment liens for fraud or student loans. Of course, there are exceptions, and the above rules may or may not apply to your particular situation.

I assume that the lien of which you are speaking is a wage attachment. If that's the case, the answer is "yes". Please contact me if you wish to discuss your options. (310) 858-9771
