Legal Question in Bankruptcy in California
Is this a bankrutcy or a bank filing for forclosure?
I just received a letter in the mail from a bankruptcy judge. How do I know if my husband filled for bankruptcy for us or if it is the bank foreclosing our home? Can my husband do this for both of us without telling me? Can I stop this and arrange a payment plan? Can I stop this if it is a bankruptcy or a forclosure?

Your message is confusing. If you received a court pleading (that is, with lines and numbers), it is a court matter -- bankruptcy or otherwise. A husband cannot file a bankruptcy for his wife, and vice-versa, without the spouse's signature on the papers. You should consult with a lawyer immediately, and bring the papers with you to get a better handle on what is going on. If you want to e-mail me, directly, the case number that appears on the papers you received from the judge, I might be able to look it up for you. My e-mail address is below. -Robert F. Cohen, Esq.
