Legal Question in Bankruptcy in California
BK question regarding car ownership
I recently filed Chapter 13 and I also own a car with a loan on it. I am behind on my payments on the car loan and am wondering if it is legal to add them to my Chapter 13 and pay on it through the trustee? Also do I only add the back payments or do I add on the whole car loan? Please let me know as soon as possible. Thank you. I appreciate your help.

If you fell behind on the payments after you filed the Chapter 13 case, then you may need to modify your Plan, although in all likelihood the scenario you describe is grounds for dismissal of your case or at lease relief from the automatic stay for the vehicle lender. You should consult with your attorney on this matter as soon as possible.
