Legal Question in Bankruptcy in California
Chapter 7 Bankruptcy
We filed a chapter 7 bankrupty and everthing was discharged. Now the loan company is saying we owe back payments of 16,000.00. Is this legal when the loan was discharged in bankruptcy. The loan was a re-finance.

Re: Chapter 7 Bankruptcy
If you are referring to a secured loan like on your house or a car, the bankruptcy doesn't get rid of the lien they have on your property. If you file bankruptcy, that doesn't wipe out the mortgage on the house. If you want to keep the property, you still need to make the payments.
