Legal Question in Bankruptcy in California
chapter 13 and owed and accumulating child support
My daughters father filed chapter 13 bankruptcy, and the DA stopped garnishment and collection procedings. I have not received support in over a year. Can I and more importantly how can lift the stay for support payments? Can the DA do this for me? or do I need a lawyer?

Well, the Chapter 13 plan SHOULD provide for catching up on the past due amounts plus provide for current payments of ongoing amounts. If it does not, you should object to the Plan and have the court require them to be provided for in the Plan. If you'd like to discuss this more, just give me a call.
