Legal Question in Bankruptcy in California

Charge Offs

I was going to file for bankruptcy a few months but haven't had the money. I just got a copy of my credit report and all but two creditors have charged off my accounts. Do I still need to file? I am asking because I am involved in a personal injury case and was told they could come after every penny I get in the settlement. Can they still do that after it's been charged off?

Re: Charge Offs

Yes, they can still seek to collect after they charge it off. They can also sell the debt to another company who can then come after you to collect, assuming it is within the statute of limitatations for doing so.

Re: Charge Offs

Yes they can. A chargge off just means that athe account is closed due to unpaid charges. If they are over 4 years old, then they cannot do anything. But before you file a 7, check with your P.I. attorney to see how much you may recover.
