Legal Question in Bankruptcy in California
collector keeps sending mail
I file for chapter 7 on December 2003 thru a bankrupcy attorney. Due to high volume of cases in BK court, my case took over a year to complete. One of the hospital is on the list of creditors. During the BK process, this hospital kept sending bill notice whereas other creditors stopped. On February 2005, it sold the bill to a collector. On March 2005, the BK process is complete with ''the debtor is granted a discharge''. But after that the collector keeps sending mail asking for payment. I original file on Dec. 2003, at that time this collector was unknown, the hospital was still the creditor. Is this debt discharged even the debt was sold after I filed for BK with the hospital as creditor? When I filed, this collector was unknown.

Re: collector keeps sending mail
The debt has been properly discharged and you should bring this to the attention of your attorney right away. The hospital violated the automatic stay each time it sent you another bill. Send a copy of the discharge order to the collection agency and the hosptal via certified mail and demand that they stop contacting you.
