Legal Question in Bankruptcy in California
Company filed bankruptcy (TWEETER)
I've been employed at Tweeter for almost 4 years. When they start closing stores/liquidation they did not let the employees know 30 day prior (Warrent Act) violation? Furthermore, all employees have a severance package comming. They owed me est $3000. But they filed chapter 11 and have at least 100 stores remaining. Can the employees negociate or get anything filed to recieve some kind of compensation.

Re: Company filed bankruptcy (TWEETER)
If you are owed wages, then you are creditor. In a Chapter 11, the creditors will typically have the opportunity to vote on the plan of reorganization. The plan of reorganiation will state the proposed amounts to be repaid, etc. Certain types of wage claims will be given priority over other types of creditors.
You will need to file a Proof of Claim with the bankruptcy court. If you or any of your coworkers need assistance with your claims, feel free contact my office for further assistance.
