I am in a consolidation program, but i still have finacial problems. one of my crediter have suit me. my question is can i go to bankrupsy?

FIRST OF ALL you need to immediately calendar your response date to the lawsuit (by your creditor). Usually the response date is 30 days from the date you are/were served with lawsuit. If you don't timely respond, the creditor will obtain a default judgment against you and can execute on the judgment, including levying upon your bank accounts, garnishing your wages, etc. Depending upon the nature of the claim/lawsuit, a bankruptcy may eliminate your liability to the creditor.
NEXT, in answer to your specific question, yes you can still file bankruptcy, assuming that you otherwise qualify to file. Only an attorney can tell you if you qualify to file bankruptcy.
