Legal Question in Bankruptcy in California
Re: Contact by Creditor after Bankruptcy is finalized
What should a person do if they are contacted by a creditor nine months after the bankruptcy is discharged/finalized? The debt in question would have been ''secured''. It was for a piece of furniture purchased in the spring of 2000. We have had no contact from the creditor in the 9 months since the bankruptcy was discharged. It's been nearly four years since this furniture was purchased and we no longer own it. No other creditor has contacted us. The debt they say is owed is approximately $1000. Can the creditor come after us at this point and what are the possible results? Thank you.

If the debt was on your BK schedules, all the creditor can do is make arrangements to pick up the merchandise or let it go. The monetary debt was discharged.
