Legal Question in Bankruptcy in California
Never conversed with atty-big errors in papers which has already been filed
I am very worried that I am going to be in trouble because I recently paid $1100.00 to file a chapter 7 bankruptcy. I was under the impression I was paying to talk to an atty about my situation and file my papers. I just received my copys of the papers that was filed with the courts and discovered that there is a lot of major errors in the paperwork and that I was not speaking with an atty during this time but a paralegal.During the process of my papers on numerous occasions I brought up about being worried about a judgement that was being process against me from a credit card bill. I was told not to worry about it. Now I just received a letter saying that the credit card co. won the judgment and they can attach my bank acct, ect. When I contacted the attys office I was told that an atty will meet me when I go to court and if there were errors in the papers for me to correct them and mail it to them. If the bankruptcy papers have already been filed and then I make the corrections wouldn't the courts wonder why there is such a big discrepancy in the figures(IRA,bank acct.,ect). Any input would be greatly appreciated.

Well, if in fact your bankruptcy was filed, the creditors can't attach anything. However, if they got a lien against specific property, it may need to be avoided in the bankruptcy. You can always hire a new attorney at any time.
