Legal Question in Bankruptcy in California
Destitute & on SSI, many debts, should i file bankruptcy?
I have nothing. live in same apt for 27 yrs.. irs started audit 1995 , & said my cpa made mistake with the nol..from my business which i closed i was told that i owe irs $15,000.. i said lets go to tax court. then i lost my job, became ill was put on state disability, which ran out in 1 year. after dr tests etc i was granted ssi dis and only get $796 mo my rent is$600.mo.every thing is happening at once. now arbitrator irs says i owe only $3,800. sign installment agreement and sign papers so arbitrator can go to court on sept 25 & say we agree. i can't sign this because i know i will never be able to pay. my cpa wants $3.700 for his 2 + yrs work. an old bank loan came up on trw for $18, 000 which belongs to the man who bought a business from me in 1984. and i borrowed $7500 from fima sba after earthquake in 1994 to replace dishes and furniture damaged. can i include all these debts if i file? since i have no money to pay can i file on my own ? does this have to be filed before the sept 25 court date with dept of the treasury?? i am just getting ill again with all of this hitting the fan at once.thanks.

Sorry to hear of your problems. Bankruptcy could help you although it is tough to say with certainty which of your debts would be discharged based on the facts you've given. The taxes most likely would not be. Any secured debts would not be. The SBA loan might be if it was not secured. You can file the bankruptcy yourself and there are kits available at bookstores for doing this, although I have to strongly recommend against that. If you decide you do want legal representation please feel free to visit my web page (below) and give me a call. Good luck whatever you do.
