Legal Question in Bankruptcy in California

discharged chapter 11

My chapter 11 was discharged prematurely because I became disabled and could not meet my payments. I am working again so what can I do to resolve my situation? Can I convert to a chapter 7?

Without knowing your individual circumstances, it is hard to say whether you can convert. But in general you can covert from any chapter to Chap. 7 and the filing fee is $15.00.

Thanks for your posting. As you can tell from our responses, it is possible to convert a Chapter 11 to a Chapter 7. Are you sure that your information is correct however? For one, if your case has been dismissed for non-payment, then you can't convert it, although you CAN file a new case, which might be easier. Also, Chapter 11s are rare for individuals, so you might be speaking of a Chapter 13. Either way, I'm happy to help you in any way that I can, and if you wish to email me with more information, or call my office, toll free, at 1-877-568-2977, I can help you.

If your case was discharged why would you need to convert it? Discharge is the goal of any chapter of bankruptcy. If you mean your case was dismissed, then you cannot convert it because it is, of course, already dismissed. You can file a new Ch. 7 case as long as the order of dismissal doesn't put a time limit on re-filing.
