It depends on where you are in the process. You should retain counsel to help you with the bankruptcy and provide him/her with all the facts so that you can maximize the positives and minimize the negatives. Additionally, even if you and your spouse hammer out a divorce agreement, you should each be aware of all your rights under your particular circumstances.
