Legal Question in Bankruptcy in California
Is there any way to enforce the payment of a 3 year old Judgment with a stipulated agreement, where the defendant has not made 1 payment, did not show up for a Debtors exam, and 2 days after receiving a wage garnishment....filed for bankruptcy? The judgment was for a car accident, defendant was at fault, and did not have insurance. I was originally asking for $10,400 dropped it to small claims level of $7,500 and settled for $5,000. The other 2 people in my car received $15,000 a piece from my uninsured motorist portion of my Insurance. We were unable to locate him for two years and when we do find him he files a no asset chapter 7 bankruptcy! I can't afford a lawyer because I am currently unemployed.

And no reasonable lawyer would take your money, because the bankruptcy wiped out the judgment. You would have saved at least $3,000 by hiring a lawyer who would have drafted a better settlement agreement, and who probably would have negotiated a better settlement for you.
