Legal Question in Bankruptcy in California

File bankruptcy more than once?

I filed bankruptcy (all dismissed) in 1993. I want to find out if I can file again. The first due to bad decisions in divorce and since I have been eeking by raising 2 kids on my own. Problems consist of increments of under $2,000 each, probably total about $7,000 but will never be able to pay back. currently unemployed, 48 years old, survivor of aneurism and must avoid stress. Still looking for job but so far not successful. Starting to panic. really want a clean slate to start again. AllI own is a car and credit is poor now anyway. The amounts are from things like back rent, money owed on car lease, one credit card. exhusband and father on welfare and does not contribute anything.

Re: File bankruptcy more than once?

You can re-file for Chapter 7 after six years from filing the first. You should review your facts with a bankruptcy attorney first, though, because the court may want to convert your case to a Chapter 13 if it feels you have enough extra income to fund a repayment plan.
