Legal Question in Bankruptcy in California
Should I file?
We own a home with a first & second mortgage. Two cars that are over 10 years old. We both work but income has decreased appx. $25,000 per year. We owe appx $30,000 in credit cards. We have appx. $16,000 in stocks & two 401 plans (appx. $43,000) We are over 50. Our credit which was very good is now very slow (bad). Should we file bankruptcy & can we do so and not lose our house?

Re: Should I file?
Bankruptcy without losing your home is a definite possibility. Whether you can keep your house or other assets depends on the equity in your home, value of your assets and what exemptions you need to take.
