Legal Question in Bankruptcy in California

How to file an LLC bankruptcy?

Wondering if and/or how my LLC would file bankruptcy. We're no longer operating, have no income to pay debtors. Less than $10,000, but don't want to be sued for this money. My partner has already filed a personal bankruptcy to include a plaintiff that is suing our LLC and us personally. I cannot file a personal bankruptcy because I filed one a few years back. Just wondering if I can at least file the LLC bankruptcy. Can this be a Chapter 7? Do I need special forms? Or can I use the same forms as a consumer BK? Thank you.

Re: How to file an LLC bankruptcy?

Corporations do not receive discharges in bankruptcy under Chapter 7, so it's unclear to me what you would accomplish by doing so. You can always file a Ch. 13 for yourself if you have personal liabilities from the corporation.
