Legal Question in Bankruptcy in California
when do I file if being sued before or after?I
I am filing for bankruptcy and sadly enough I have an old landlord sueing me for back rent, can I put him on the list for bankruptcy and if so at what point. after the case is heard or before the case is heard?

Yes, of course you can list your prior landlord suing you for back rent. You may be relieved of past due rent incurred PRIOR to the filing of your bankruptcy. You do not have to wait for the landlord to obtain a judgment against you before you file.
Note: If your old landlord is also alleging that you damaged the premises, there is the possiblity he/she could try to contest the dischargeability of the debt.
Best of Luck,
