Legal Question in Bankruptcy in California
Ex Filed Bankruptcy on Child Care Costs
I have a court order that says my ex must pay 1/2 of all day care and medical related costs. He has refused to reimburse me, as required in the order, after being properly notified of those costs. He just filed Bankruptcy with me as creditor for those costs. Is that legal? Can I still collect somehow?

Re: Ex Filed Bankruptcy on Child Care Costs
Child support debts are non-dischargeable. Whether these constitute child support is up to the court. You should consult with a knowledgeable bankruptcy lawyer in your area to discuss filing a motion for determination of dischargeability of debt.
