Legal Question in Bankruptcy in California

Filing bankruptcy

Can I file a bankruptcy petition in California even though I am presently living in Texas, or out-of -state? California is my home state. I earned $8,800. last year and will probably make the same this year. I was assigned a lawyer through a legal aid firm, but I don't understand, they are not filing my claim say week after week that the ''court's'' computer system is down and is updating. I have no major charges on credit cards in last six months. Is it possible to file my claim in California? Thank you for taking the time....

Re: Filing bankruptcy

You need to file bankruptcy where you live, not where you are from. Bankruptcy courts are updating their computers all over the country, so the legal aid firm is probably telling the truth about the computer system. In March, the entire computer system was down for the Counties of Riverside, Orange, San Bernardino and Los Angeles for an entire weekend. Just be patient and see if they can file the case next week.
