Legal Question in Bankruptcy in California

filing bankruptcy from prison

Can an inmate file bankruptcy from prison? How would he go about doing it? Is there a way to do it for free? He has absolutely no assets at present. His debts are from credit cards and an unpaid loan. If he filed bankruptcy and then received funds later on through a lawsuit, would this be fraud? He may get nothing. Can the creditors take these funds (if he got anything) while he is incarcerated?

Re: filing bankruptcy from prison

If he has no assets, why worry about filing a BK. He's probably judgment proof. Should he obtain assets in the future, then it's something to be considered.
