Legal Question in Bankruptcy in California

Filing chapter 7

I lent $14,000 to a friend. $9000 was a check written by me from a line of credit and the balance was a credit i let her use. She has paid the minimum payments up until now. She says she can't afford to pay anymore. In november i transferred the whole balance to a credit card with a 5.9% interest rate to help pay off sooner. I've been disabled since november, 2001. I was just approved for ssdi. I am married but my husband has no obligation to pay this debt. Under my name only. I have no other debts. Spotless credit record. I don't want to pay her debt. Can i file chapter 7? Thank you. Debbie

Re: Filing chapter 7

There are a lot of issues here and you may run into a situation in a Ch. 7 where the creditor in question objects to your discharge based on fraud. The balance transfer in November makes things even worse. You need to consult with an attorney to go through your situation in more detail. I will be happy to do so. If you are interested, please visit my webpage at http://www.bklaw.com/consult.html and then contact me to schedule a time.
