Legal Question in Bankruptcy in California
foreclosure
We have recently filed for bankruptcy. Our closing date has passed. We filed ch. 7. Since that time we have fell behind in our house payment. We have received a notice in the mail that we must go to court because our lender wants to proceed with foreclosure. Can we refile under ch. 13 to protect our home? If not what options do we have?

Re: foreclosure
I believe you can file a Ch. 13 to catch up on the arrearages on your home assuming that your income and expenses show an ability to do that. It may also depend on the date you receive a discharge in a ch. 7. If you live in the Greater Los Angeles area and would like a consultation, please visit my website at http://www.bklaw.com/bklaw and give me a call at (818)509-1173 and I will be happy to assist.
