Legal Question in Bankruptcy in California
my grandmother wants to file for a chapter 7 bankruptcy to rid her of her unsecured debts. For the last 30 years her only source of income has been social security benefits and she has not filed her income taxes in any of those 30 years. Will she need to file income taxes in order to proceed with a chapter 7 and be able to discharge her unsecured debts? My question is not asking if she can discharge income tax debt. My question is "will she need to file her income taxes"? If she does not have to file her income taxes, is there a seperate form she will have to fill out?

If, according to the IRS, she does not have a tax-filing requirement, then she does not have to file a tax return for chapter 7 bankruptcy purposes. Her attorney will help her sign a declaration to that effect; no special form is required.
