Legal Question in Bankruptcy in California
Hey!
Brought 300 lbs of copper to a certified CA recycle center on the 5th of Jan., is a 3day waiting peroid on large amount of metal before you get paid. (CA law?) Recycling center filed chapter 11 on Jan.
8th and remained closed for aprox 1 week. Now they are open for business, but will not honor vouchers given before the 8th.
Does being a certified recycle center, or the 3day wait rule (if a law) do anything to help me get the money they owe me?
Is there anything I can do besides cry. =(

Creditors can get paid through a bankruptcy, however it boils down to a cost-benefit analysis: would their claim exceed potential costs in time and legal fees? Think principal, not principle.
You can contact a bankruptcy attorney in your area and state your claim amount. He or she can advise whether you have a viable or practical claim or if money might be better spent on tissues.
You are now a creditor in the Chapter 11 case for the recycling center. Your only remedy right now is to file a proof of claim with the bankruptcy court and see what happens. You may or may not get paid.
