Legal Question in Bankruptcy in California
Husband threatening to sue me if I file Chapter 7
I have filed for divorce and make only $19,200 yr I have begun the bankruptcy process and now my spouse whom I do not live with is threatening to sue me after the creditors go after him. He makes 3x's more money but we don't have any assets only debt. Credit cards in my name, incurred during marriage. What are his chances of winning and garnishing my wages wherever I am? He won't pay any spousal support and I have no choice. It seems I lose either way I go. Thank you for reading this.

Re: Husband threatening to sue
I understand the question. If he sues you after you file bankruptcy the court can fine him or throw him in jail for filing the lawsuit. Dont worry about it, if you have decided that a bankruptcy is what you need to do, go ahead and do it.
Re: Husband threatening
Sue you for what?? I don't even understand the question. If he is failgn to pay court ordered spousal support, that is a criminal offense and you should have your attorney go after him for that. I can't answer your question about him garnishing your wages since I can't imagine what it is he would be suing you for.
