Legal Question in Bankruptcy in California
Liens
When my parents filed for bankruptcy there were two liens aleady in place on their home. Although the debts to these creditors were discharged, the liens they placed were not removed. Now they would like to refinance but are afraid of the liens on the property. How can they romeve them and will they need an attorney for this or can they do it themselves?

They would have to reopen their bankruptcy case and file motions to avoid the liens. I have no idea whether they can do this because it depends on the value of the property and the amounts of each of the liens and encumbrances against the property as of the date the bankruptcy case was filed.
