Legal Question in Bankruptcy in California
Losing husbands income should I file bankruptcy
My husband is in a nursing home and his insurance only covers 100 days. Medi-cal will cover the cost after that but they will take his Social Security check. We have credit card debt and I will not be able to make the payments without his check. Should I file bankruptcy and can I file for both my spouse and myself. He is not mentally capable of handling his own affairs.

He does not need to file with you in order to be protected by the bankruptcy discharge. Whether you should file can only be determined after a comprehensive consultation.
