Legal Question in Bankruptcy in California

Im behind on my mortgage payments,I tried to modify my loan but I have not heard anything for months from the bank,my question is what can happen to my house if I file bankruptcy?

This will depend on what type of bankruptcy case you are filing. If you are filing for Chapter 7 bankruptcy and are not current on your mortgage then they company will move to lift the stay so that they can move to foreclose on your property. If you are filing Chapter 13 to try to save your home, then your attorney should try to propose a feasible plan to pay the arrears on your mortgage within the plan if possible. Chapter 13 plan can allow you to catch up on your past due payments so that you can stay in your home.
