Legal Question in Bankruptcy in California
Omitted Credit Card Debt
I filed a Chapter 7 Bankruptcy in 12/89 and just recently was sued for a credit card debt that had been assumed through my divorce in 1988 by my ex-husband. I found out that because he had filed bankruptcy in 1993 they were coming after me to collect. Can this debt still be discharged through my bankruptcy in 1989?

Omitted Credit Card Debt
If the debt was incurred prior to your bankruptcy case being filed, and there were no assets distributed to your creditors and you received a discharge, then that debt was automatically discharged along with your other debt.
