Legal Question in Bankruptcy in California
Do I owe
We filed bankruptcy the end of 1999, and completed early 2000. When we filed, we forgot about one creditor, and did not add them to the list. We did post in the newspaper that we were disolving our debt, but this creditor did not come forward, nor had they referred us to the credit bureu. Here is is April 2003, and this creditor has sent us a demand for payment. Are we required to pay this? What should we do? We are still unable to pay any debts, and have not incurred any since our bankruptcy.

Re: Do I owe
If you filed a Ch. 7 case with no assets distributed, then the debts was discharged along with all your other debts. You should provide a written notice to the creditor of your bankruptcy filing, certified mail. If they continue to pursue collections, you may have to reopen your bankruptcy case to seek a contempt of court action against them.
