Legal Question in Bankruptcy in California
Pawnshops, Theft of Assets in Bankruptcy
I am presently starting to file Bankruptcy. I have liens on a 'Purchase Money Security Interest' to Sears for: 1. Items I have had to pawn. 2. Tires and a brake job on my granddaughters 1992 Toyota Tercel that was stolen the same day. How do I account for these items?

Pawnshops...etc
As for the stolen items, as long as you have a police report, I can't imagine SEARS could force you to do anything. As for the pawned items, SEARS could require you to pay the current fair market value of the items that were pawned.
