Legal Question in Bankruptcy in California
I posted the below question and got two excellent responses. I need to know the same answer but if my x-spouse files bankruptcy also, can she file against the same fees? If she does, does it clear the way for me to also?
"In my divorce decree I am responsible for 50% of my x-spouses lawyer fees. I am now filing bankruptcy, Are the fees i am required to pay now dischargable?"

Her debt is to her lawyer and that has nothing to do with support. It is a simple debt for a service that she would be able to discharge in bankruptcy unless the debt to her lawyer is secured by property. Your debt to her lawyer is most likely in the nature of or in lieu of support and not dischargeable as a support obligation.
