Legal Question in Bankruptcy in California

reaffirmation agreement

I just had my creditor meeting and I need to file a reaffirmation agreement with the court since I did'nt use a lawyer. Do I get forms from the clerk for that?

Re: reaffirmation agreement

You can find the form at http://www.canb.uscourts.gov . Click on the "forms" tab on the left and scroll down to Reaffirmation Agreement. Have your creditor file it with the court (they know the procedure, you probably don't). The court will set a hearing date, and you will have to prove that a reaffirmation won't cause you further financial difficulty, that you have the means to pay each month, and is necessary for your well-being such as getting to work, etc. Often creditors will agree to take payments even without a reaffirmation agreement.
