Legal Question in Bankruptcy in California
Repossession
A friend of mine had his car
repossessed when he went thru a
divorce. 3 years later he gets a call
from the collection agency that they
show no record of his car being
repoed and its still in his possession.
He has no record of them repoing it
since it was late at night What does
he do to find out the where about of
the vehicle to prove it was
reossessed? they are trying to make
him responsible for the vehicle??? Is
this legal?

It's interesting that they're coming after him three years later. He should tell them not to call him again -- after he gets their name, address, and phone number. Then, he could have a lawyer send a "cease-and-desist" letter to them and the original creditor.
