Legal Question in Bankruptcy in California
restitution after bankruptcy
a company filed chapter 7 bankruptcy. the company was being paid restitution through court order monthly by a person who committed a crime. where does the money that is paid to the court by person paying the restitution go? do owners of the private company have access to the restitution being paid? does that person who is paying the restitution still have to pay or do they have the ability for reduction in amount owed or something of that nature?

Re: restitution after bankruptcy
The restitution still needs to be paid. The money should be paid to the Chapter 7 Trustee. The Chapter 7 Trustee will pay the money to the company's creditors. You probably can work out a settlement with the trustee, but you should use an attorney to assist you with this process.
