Legal Question in Bankruptcy in California

school loan debt cancellation

i have recently been granted a chapter 7 bankrupcy discharge (about 10,000 credit card debt). my school loans were not dismissed, of course, which amount at this point (with interest and collection charges) to about 100,000. i live on disability, cannot be substantially gainfully employed, and will never be able to pay this debt. i've been told my case is winnable, but the lawyer i consulted estimates her cost to be 5,000 to 7,000. is this the going rate for such a case? please advise.

Re: school loan debt cancellation

If you're talking about litigating an undue hardship action against the student loan lender, I would say $5,000-7,000 is very reasonable. You are talking about a full blown trial which will be heavily contested by the student loan agency regardless of the facts.
