Legal Question in Bankruptcy in California

Spouse want to file for Bankruptcy & I don't

My spouse wants to file for bankrupcy, because my spouse says there too many bill's I don't want to file and I don't want to pay for his obligations. I tried talking to him and he says I should see his lawyer. We have things to get there that I want to keep and I willing to pay for them, but I think my spouse wants to leave me and that is why he wants to file for bankruptcy, I just don't want to get stuck paying the bills my spouse rang up with out my knowelgede and I don't want my credit history ruined because he filed for bankruptcy.

Well, you haven't really asked a question so I'm not sure how to reply. If your spouse's cards are in his name only and he had them prior to marriage and you never used the cards, then chances are you are not obligated on them. That being the case, his filing a bankruptcy should not affect your personal credit if you become divorced. However, there are a myriad of issues involved here and any legal advice could only be given after a comprehensive analysis of all the facts. You should be aware that your community property assets are liable for any debts that he has incurred during marriage whether they are your personal liability or not.
