Legal Question in Bankruptcy in California
Stopping a wage garnishment when waiting for Chapter 7 discharge
I would like to know if a creditor is allowed to continue collection of a judgment by wage garnishment when the debt is included in a chapter 7 bankruptcy action. If the creditor may continue collection, How can it be stopped pending discharge?

Of course not. You should have your attorney either write a letter, or if that doesn't work, file a Motion for Contempt and Sanctions pursuant to 11 U.S.C. 362(h) and 105. If you need an attorney, please call me at (818)509-1173.
