Legal Question in Bankruptcy in California
Student loan dismissal
I would like to know if Stafford student loans are dismissable when filing chapter 7 bankruptcy. My disbursment date was 9 years ago. I understand that if a student loan is over 7 years old then it can be dismissed. Is that true??

Re: Student loan dismissal
First of all, I believe you mean "dischargeable", rather than "dismissable". Second, the answer is no, that is not true. Student loans are only dischargeable upon a showing of undue hardship. For information on this, please visit my webpage at http://www.bklaw.com/chapter7doc.htm .
