Legal Question in Bankruptcy in California
Time table on judgement
How long does the bankruptcy process take and when and how does a judgement get discharged. My daughter can't get her driver's license back because of a judgement against her from an insurance company. They don't seem to want to work out a payment plan and they won't allow her to get her license back until she pays in full.

Re: Time table on judgement
Over the last 2 years, every single Chapter 7 case I have handles took about 3/5 months before the discharge was entered. Chapter 13 cases are repayment plans that generally last 3-5 years.
Your daughter needs to consult with a local bankruptcy attorney to see if bankruptcy is truly an option for her. Filing bankruptcy can be very complex and it isn't for everybody.
Re: Time table on judgement
It will take 3-4 months from the date of filing for the debt to be discharged. However, depending on the DMV office and the clerk, it is often possible to have the license issued with just proof of filing the BK.
