Legal Question in Bankruptcy in California
Welfare Reinbursment VS. Child Support
I filed a Chapter 7 against the Riverside County D.A. in California for a 11year old debt involving welfare reinbursment. As far as I can tell the debt was discharged, (it was the only debt claimed in the proceeding). The Riverside County D.A. however claims that this is not a dischargable debt and continues to threaten susspention of my drivers licence if the debt is not paid. The discharge of debtor I recieved from the court is unclear as to the status of the debt. How can I find out if the federal government considers this debt discharged.

Welfare Reimbursement vs. Child Support
I would need more information on this "welfare reimbursement" debt to render an opinion, but I can say that the exceptions to discharge are find in bankruptcy code section 523 (11 U.S.C. 523(a)). You can find this at http://www.law.cornell.edu/uscode/11/523.shtml If this is a fine or penalty paid to the government, it is probably not discharged. If it is part of a divorce decree it is probably not discharged. If you need to discuss this further feel free to give me a call for a consultation.
