Legal Question in Bankruptcy in California

I have been working with a loan modification company for almost a year now. I paid them almost 3k and I found out today they claimed BK. My loan mod was never completed. Do I have any recourse to recoup the lost money? I live in Arizona, but the company is in California.

Sue them for fraud as fraud is not dischargable, and it was a scam. Contact me directly.
